Learner discipline in South Africa: what teachers can do and what belongs to formal process

Start with the school Code of Conduct

Section 8 of the South African Schools Act requires the governing body of a public school to adopt a learner Code of Conduct after consultation with learners, parents and educators. The Code is intended to establish a disciplined and purposeful school environment, and learners attending the school are bound by it.

A teacher should not have to invent a discipline system from scratch in the middle of an incident. The school Code should identify rules, procedures and the disciplinary structure that applies at that school.

What belongs at teacher level?

Teacher-level responses are immediate, proportionate actions used to stabilise teaching, restate the rule, direct the learner back to the task and apply a consequence the school process actually authorises. Detention, demerits, confiscation processes, removal from a lesson and similar measures can depend on the school Code, provincial rules and school procedure.

The practical test: is the response proportionate, non-humiliating, non-violent, connected to the misconduct, and actually authorised?

What belongs to formal process?

Serious misconduct, repeated unresolved misconduct and matters requiring formal disciplinary proceedings move beyond a teacher acting alone. Suspension and expulsion are formal powers governed by legislation and due process.

Corporal punishment is prohibited

The South African Schools Act prohibits corporal punishment. Discipline should use lawful corrective measures, school procedure, safety and due process rather than physical punishment.

When the same problem keeps returning

Do not treat each repeat as an unrelated first incident. Keep a short chronology of what happened, what immediate step was used, who was informed, what response followed and whether the conduct returned.
